Booking Conditions
We are sure you will have lots of fun on your trip out with us today, however, with every sports adventure there can be risks that you need to be made fully aware of. It is a physical activity which may lead to possible injury or harm. Please read this carefully and in order to take part in this fun adventure, you MUST agree to this disclaimer and you MUST be aware that you are taking part at your own risk.
TERMS AND CONDITIONS
All prices are shown in UK pounds sterling (£) as quoted on the website and online booking area.
ALL BOOKINGS ARE NON-REFUNDABLE.
Please be aware if you miss your scheduled Tour you will NOT be eligible for another booking or refund. If you are not present at your scheduled departure time our Guides will begin the Tour without you. If, for any reason, Canoe and Kayak Tours Limited cancel the Tour we will endeavour to accommodate you on another Tour or refund the cost of your Tour in FULL.
You MUST arrive promptly for your Tour, we will NOT wait for late arrivals.
Our Tours operate in most weather conditions; however, we will NOT operate in strong winds, heavy rain or lightening. We can not guarantee fine weather here in the UK, therefore, we recommend you check the weather report for the Windsor area prior to your Tour. If the Tour is postponed due to adverse weather conditions we will accommodate customers at their convenience on another Tour where possible.
A minimum number of participants may be required for our Tours to operate.
Smoking is NOT permitted on any Tour.
If any participant is under the influence of alcohol and/or drugs you will NOT be permitted on the Tour.
An adult MUST accompany a child aged 13 and under. ALL children MUST be aged 7 or over. All children aged 14-17 are classed as responsible and will be charged the adult price.
If a Tour is cancelled by the customer NO REFUND will be given.
If we deem any participant's behaviour offensive or a nuisance to other river users we shall withdraw them from the Tour and have no further liability.
All matters concerning your booking will be subject to English Law.
Whilst every effort is made to return Lost Property, Canoe and Kayak Tours Limited will NOT be held responsible for property left on or in the Canoes.

This contract sets out the terms and conditions that will govern our supply of your Canoe tour (The Tour) to you. As a consumer, you have legal rights in relation to services not carried out with reasonable skill and care. Nothing in this contract will affect these legal rights.
Health and Safety and Important information
Weather and water conditions can change quickly and although very rare, dangerous situations can occur, including you falling into the water and/or the vessel capsizing which in turn could lead to injury and even death. Kayaking or canoeing is also a physical strenuous exercise. In order to participate in the Tour, you MUST therefore:
· Be able to swim 10 metres; and
· Be of reasonable health and physically able to partake in the activity forming part of the Tour,
And you warrant that this is the case and that you have disclosed to us at the time of booking any and all medical conditions, medication or other issues that could have an impact on your participation in the Tour prior to the Tour Commencing.
1.2 If, in our reasonable opinion, we deem that you are not going to be able to participate in the Tour, we reserve the right to refuse your participation without any further liability on our part.
1.3 For your own safety, it is also of upmost importance that:
· You maintain a safe position (as per our instructions) whilst in the vessel
· You wear the buoyancy aid supplied to you by us at all times
· You listen carefully and adhere to all instructions that we give you as these are for your own safety
And if you fail to follow our instructions and/or maintain a safe position in the vessel and/or wear your buoyancy aid, we reserve the right to terminate your participation in the tour and no refund will be provided to you.
No children under the age of 18 may participate without being accompanied by a parent or legal guardian.
Liability and Responsibility
1.1 If we fail to comply with this contract, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of this contract or our negligence, but we are not responsible for any loss or damage that is not reasonably foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by us at the time we entered into this contract.
1.2 We do not exclude or limit in any way our liability for death or personal injury caused by our negligence or the negligence of our employees or for fraud or fraudulent misrepresentation.
1.3 We cannot accept any responsibility for any property you leave on our premises during the Tour or any property that you bring with you that become damaged during the course of the Tour and you do so solely at your own risk. We strongly recommend that you do not bring anything that may become damaged by water or hard knocks, including without limitation cameras (unless waterproof and in protective casing), mobile telephones or other electronic equipment, watches or similar.
1.4 In absence of any negligence or other breach of duty by us and subject to the terms set out above, you will be responsible for any loss, theft, damage to property or personal injury to yourself or others caused by your actions or inactions.
1.5 Wear and tear of the vessels and the equipment is inevitable but we will endeavour to ensure that all vessels and equipment supplied to you is of reasonable quality and fit for purpose.
1.6 We understand that accidents happen and we will not charge you for any wear and tear on the equipment or vessels. If however any damage is caused by your negligence or failure to adhere to the terms of this agreement or our reasonable instructions to you from time to time, we reserve the right to charge you the costs that we incur repairing or replacing the damaged equipment or vessel or otherwise in making good such damage.
2. Events outside of our control
(a) We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this contract that is caused by an event outside our control, including bad weather, closure of the waterways, disease, injury of a tour guide, damage to or breakage of the vessels or equipment or similar.
(b) If such an event occurs we will try to move the Tour to another location or, if this is not possible, we will contact you as soon as reasonably possible to notify you and seek to rearrange your Tour if possible.
(c) In the event that the Tour that you have booked cannot go ahead, you may either book another tour or cancel the contract if you no longer wish to take part in the Tour, in which case we will give you a full refund of any sums that you have paid to us in advance.
3. Cancellations and refunds
3.1 You may cancel a Tour up to 48 hours before the Tour is due to take place. If you cancel you’re Tour under these circumstances and you have made any payment in advance for a Tour that has not been provided to you, we will refund these amounts to you.
3.2 If you cancel a Tour with less than 48 hours notice we reserve the right to charge you a cancellation fee which will reflect any losses we have suffered as a result of the cancellation up to the full cost of the Tour.
3.3 We may cancel the contract at any time with immediate effect and without any further liability to you by giving you written notice if:
(a) you do not pay us when you are supposed to; or
(b) where any of the provisions set out in clause 1.2 and/or 1.3 applies.
3.4 If we cancel the contract under the provisions of clause 4.3 (a) or (b), we shall not be obliged to provide you with any refund other than where we cancel due to us determining any medical condition that you have disclosed to us in advance would render your participation in the Tour unsafe
3.5 By signing this contract you agree to the terms as they are set out and that you have been notified of the potential risks and dangers of participating in the Tour. You also acknowledge that specific attention has been drawn to the health and safety element of these conditions and that you agree to adhere to and abide by all our instructions from time to time and that any failure on your part to do so shall be wholly and solely at your own risk.

Canoe and Kayak Tours Ltd pass your information (name date of Birth, Postcode , gender and email address) on to Canoe England a division of the British Canoe Union, the governing body for canoeing in the UK. The information will be used for satistical reporting on the GoCanoeing site to support with monitoring participation. Personal data will be used only in accordance with the BCUs notification under the Data Protection Act 1998 and in compliance with the Fredom of information Act 2000 and GDPR 2018 Act . Your contact details will not be passed to third parties without your Permission.

REFUND POLICY
We at CKT Limited like our customers to be prompt and ready for your Tour. Please be advised that if you miss your scheduled Tour you will NOT be eligible for an alternative booking or refund.
If CKT Limited have to cancel your Tour for whatever reason we will endeavour to place you on another Tour or refund you the Tour price.
Tours will be guided by the weather and they will not operate in heavy rain, very strong winds or lightening. Please check the weather forecast for the Windsor area.
NO REFUND will be given to any person who is under the influence of drink or drugs.
Tours are NON-REFUNDABLE, however, rescheduling can be offered.
LOST PROPERTY POLICY
CKT are not responsible for any items lost during our Tour or left behind before or after your tour, If we do find any belongings we will contact you and it is your responsibility to collect the items. If items are not collected within ONE MONTH then they will be given to a local charity of our choosing.
